RestageHQ.

These Terms of Service ("Terms") govern your use of the RestageHQ website and service at restagehq.com (the "Service"), operated by GoJas Enterprises LLC ("we", "us", "our").

By accessing or using the Service, you agree to these Terms. If you don't agree, don't use the Service.

1. Eligibility

You must be at least 18 years old and have the legal authority to agree to these Terms. If you're using the Service on behalf of a brokerage, team, or company, you represent that you have authority to bind that entity to these Terms.

You agree to provide accurate information when creating your account and to keep it up to date.

3. Subscription and payments

Billing

Paid plans are billed monthly in advance through Stripe. Your subscription auto-renews each billing cycle until you cancel. By subscribing, you authorize us to charge your payment method for the recurring fee.

Photo allowances

Each plan includes a monthly allowance of staged photos (25 for Starter, 100 for Pro, 500 for Team). Unused photos don't roll over. Exceeding your allowance either pauses rendering until the next billing cycle or can be upgraded with additional credits at $3 per photo.

Refunds

We offer a full refund within 14 days of your first payment if you're not satisfied. After 14 days, payments are non-refundable, but you can cancel at any time to stop future charges.

Changes to pricing

We may change prices with at least 30 days' notice. Price changes won't apply to your current billing cycle. If you don't agree with a price change, you can cancel before it takes effect.

4. Your content

Ownership

You own the photos you upload and the staged outputs we generate for you. Full commercial rights are included in every plan — you can use staged images in MLS listings, marketing materials, social media, printed flyers, and any other lawful purpose.

License to us

To provide the Service, you grant us a limited license to process, store, and display your photos solely for the purpose of providing you with staged outputs and improving your experience on the Service. We don't use your photos to train AI models without your explicit opt-in consent. We don't share your photos with other users or third parties except as necessary to provide the Service.

Your responsibilities

You represent that you have the right to upload every photo you submit, and that your use of the Service complies with all applicable laws, including MLS rules, fair housing laws, and virtual staging disclosure requirements in your jurisdiction.

6. Intellectual property

The Service — including our software, branding, design, trademarks, and all content we provide — is owned by us and protected by intellectual property laws. You get no rights to our IP beyond what's explicitly granted in these Terms.

7. Service changes and availability

We strive for high uptime but don't guarantee the Service will be available at all times. We may update, modify, or discontinue features with reasonable notice. Scheduled maintenance will be announced in advance whenever possible.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES — EXPRESS OR IMPLIED — INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

AI-generated images may occasionally contain imperfections. You are responsible for reviewing staged outputs before using them in listings. We don't guarantee that staged images will always be photorealistic, free of artifacts, or suitable for every use case.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM OR RELATED TO THE SERVICE WON'T EXCEED THE GREATER OF (A) $100 OR (B) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE.

WE WON'T BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS OR LOST OPPORTUNITIES, EVEN IF WE WERE ADVISED OF THE POSSIBILITY.

10. Indemnification

You agree to defend and indemnify us from any third-party claim arising from: (a) your use of the Service, (b) your photos or content, (c) your violation of these Terms, or (d) your violation of any law or third-party rights.

11. Termination

You can cancel your account at any time from your account settings or by emailing us. We may suspend or terminate your account if you violate these Terms. On termination, your access to the Service ends and we'll delete your data per our Privacy Policy.

12. Governing law

These Terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-law principles. Any disputes will be resolved exclusively in the courts of the State of Florida, United States.

13. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we'll notify you by email or prominent notice on the Service. Continued use after changes take effect constitutes acceptance of the new Terms.
